It may not be at all a transition hearing around 10 October, the one that has just been celebrated in front of the bankruptcy college chaired by judge Ugo Scavuzzo on the request of the judicial liquidation prosecutor for the ACR Messina team. This is because the judicial commissioner appointed by the court, the lawyer Maria di Renzo, who together with the technical-accounting consultant Corrado Taormina is working on chance, officially expressed a negative opinion on the proposal made by the company’s lawyers, the lawyers Gianpiero Picciolo and Giuseppe Cicciari, to propose a return plan on the basis of the so-called “business continuity”. In the hearing then the prosecutor, who was represented by the substitute Fabrizio Monaco, reiterated his request to the judges to declare the “failure” of the football club.

On 8 August the judges had granted a 60 -day extension to the request of the ACR Messina for the presentation of a proposal for the composition with creditors or the other tools provided for by art. 44 of the legislation on the matter, which refers to art. 39 of the business code. The bankruptcy judges in essence had considered the “justifying reasons” given by the company to grant the extension, proven by the preparation of a project to regulate the crisis and the insolvency pursuant to art. 44 But after the hearing this morning the scenario seems to have changed. The judges retired from a few minutes in the council chamber is their decision, perhaps definitive on the matter, it is expected in the morning.
