Five years and eight months requested for Giovanni De Luca, 35 years old, detained since last summer on charges of attempted murder and illegal possession of a firearm for the shooting that occurred on 21 July 2025 on the Sant’Angelo seafront in which a 49-year-old man, a native of Rossano and resident in Germany, was injured. In fact, yesterday the hearing was held in the trial celebrated with the abbreviated procedure both against De Luca, defended by the lawyers Ettore Zagarese and Antonio Pucci, and the other two subjects investigated and involved in the affair, namely Gianluca and Giuseppe Pacenza, respectively uncle and nephew aged 35 and 31, the first defended by the lawyers Antonio Pucci and Sebastiano Campanella and the second by the lawyer Fulvio Ginocchiere, against whom the charge of charge of robbery in conspiracy, prior to the attempted murder. The public prosecutor requested a sentence of 3 years and 4 months for the two of them, while the defenders requested acquittal because the crime does not exist and, in the alternative, the reclassification of the crime as theft and concurrent injury. De Luca’s defense also asked for the crime to be reclassified as injury and in the alternative to negligent excess of self-defense, arguing that their client was armed because in the days preceding the Sant’Angelo shooting he had been threatened and felt in danger.
