From the fight with a knife in the nightlife venues of the city center to the most severe prevention measure: the Court of Catanzaro – Prevention Measures Section, on the proposal of the police commissioner of Vibo Valentia and following the investigations carried out by the Anti-Crime Division, decreed special surveillance with mandatory residence for a 26-year-old young man resident in the capital of Vibo.

From violation of the Dacur to aggravation

The story originates from a violent brawl that took place inside a club in the centre, during which the 26-year-old was caught in illegal possession of a knife. An episode that had pushed the commissioner to issue the Dacur (Ban on Access to Urban Areas, also known as urban Daspo) against him, preventing him from entering nightlife venues.

Despite the provision, the young man repeatedly ignored the provisions: surprised by the Flying Squad agents inside premises forbidden to him, he was reported to the Judicial Authority. For this crime – which involves imprisonment of up to three years and fines of up to 24,000 euros – the measure was initially aggravated, extending the ban to three years and imposing the obligation to sign daily at the police offices.

The Court’s decision

The repeated failure to comply with the prohibitions led the commissioner to formulate a new and more severe proposal. Accepting the investigative system of the State Police, the judges of the Court of Catanzaro recognized the persistent and current social danger of the young man, ordering special surveillance with the obligation to stay in the municipality of residence.

The imposed requirements

The provision now imposes strict limitations on the 26-year-old’s personal freedom:

Obligation to stay: prohibition to move away from one’s municipality of residence and to leave the home without prior notice to the Authorities;

Curfew: obligation to stay at home in the evening from 9:00 pm until 6:00 am the following morning;

Social prohibitions: impossibility to participate in public meetings and absolute ban on habitually associating with people with police prejudices.
