A medical gas at off-market prices: damage worth a million. A manager of the ASP of Cosenza was sued

Suing a manager of the Provincial Health Authority of Cosenza for fiscal damage of approximately one million euros. The Regional Prosecutor’s Office of the Court of Auditors at the Jurisdictional Section for Calabria in Catanzaro notified the act, based on elements emerging from an investigation delegated to the Financiers of the Provincial Command of Cosenza.

The investigative activities, coordinated by the Regional Prosecutor Romeo Ermenegildo Palma and the Deputy Prosecutor General Giovanni Di Pietro, were carried out by the Financiers of the Castrovillari Company through checks on the documentation acquired during the investigations, and analytically analysed, relating to the supply of a medical gas, necessary for the correct carrying out of healthcare activities.

Specifically, the ASP manager was accused of failing to carry out – in the exercise of his functions – the administrative requirements necessary for the completion of a new tender for the assignment of the “pure medicinal gases” supply service; in practice, due to this omission, the ASP continued to obtain supplies of the product from a supplier company, paying a price significantly higher than that on average charged by other companies for the remaining hospitals in the province.

This anomaly emerged, in particular, from reading a procurement contract stipulated in 2005 between the Provincial Health Authority and a supplier company operating in the specific commercial sector – never updated and extended for over ten years in total disregard of the legislation on procurement for the Public Administration – due to which, essentially, the amount paid had never been adjusted to current market prices. The tax damage, caused continuously for the years from 2019 to 2023 and reconstructed by the Fiamme Gialle Castrovillaresi through the analysis and comparison of purchase invoices relating to the same type and quantity of medical gas applied by the various companies supplying all the hospital facilities involved head of ASP Cosenza.
