The Court of Palmi, in collegial composition, with sentence no. 21/2024 of 6 November, published the following day, accepted the appeal for the liquidation controlled by over-indebtedness proposed by the lawyer. Glenda Prochilo proceeding with the write-off of 787 thousand euros of debts with the tax authorities.
The individual company FF, operating in the municipality of Gioia Tauro, established in 2008 and closed in 2016, had accrued various debts with the State amounting to 787 thousand euros claimed by the Revenue Collection Agency as well as debts towards other private creditors relating to various supplies for the work carried out. Given the situation of over-indebtedness in which it had incurred, i.e. a manifest objective and persistent imbalance between the obligations undertaken and the assets that could be readily liquidated to meet them, the Court, verifying the real and modest availability of the individual company FF, allowed the opening of the controlled liquidation for the purpose of writing off all debts contracted, declaring ineffective the withholdings for loans and salary-backed loans in progress, so as to restore one’s personal position without any tax or private credit debt.
