And there are two. The appeal presented by the CGIL against the Municipality, alleging anti-union conduct, was also rejected. The decree of the Labor Court was published on Saturday and pronounces itself, as had already happened in the case initiated by the CSA union, on the matter concerning the horizontal economic progressions at Palazzo Zanca, one of the reasons for the strike proclaimed in the middle of the summer. The same Court, however, declared the CISL’s intervention inadmissible.
Everything revolved around the new ranking of career progression, a provision by the general secretary-general manager Rossana Carrubba which modified the criteria previously agreed upon by the unions with the previous general manager, Salvo Puccio, effectively restricting the number of beneficiaries (which previously corresponded to all those entitled among municipal employees, and we to 50% of them).
The Court, rewarding the Municipality’s defensive line entrusted to the lawyer Santi Delia, essentially reiterated that the integrative bargaining cannot “exceed” the limits set by the law, which are “selectivity, the limitation of the number of beneficiary employees and the respect imposed by the quantities of available resources”, limits that were not guaranteed by the previous agreement. According to the judge, the Municipality’s decision to make an about-face, modifying the criteria, is also lawful: otherwise “it would have had to block or cancel the procedure, damaging the rights of the workers identified as beneficiaries of the economic rewards provided for by the law and of the collective bargaining agreement itself”. In other words, the Municipality could not have acted differently.
