The first important victory of the workers and the Filt-Cgil Calabria against the Tre Emme company of Montalto Uffugo who conducted “a contemptuous anti-union activity typical of the darkest years of the denial of fundamental rights of workers and their representatives”.
The “contemptuous” business attitude was first contrasted by the ability to struggle for workers, never less even when the most combative ones were fired as well as the union representative (for the dismissal of which we have already given the judiciary to contest the illegitimacy of the measures).
Over the past few months, in the face of the right claims of the workers and our union organization, the company has submitted many workers to false disputes who fought for compliance with the contractual rules and rights sanctioned by the law, on the excuse of creating the conditions for fire those who were not welcome. Over the course of a few months there have been multiple dismissed workers (and our company representative) and fixed -term workers not confirmed, coincidentally all registered with the CGIL.
Filt-Cgil Calabria and the Province of Cosenza, together with the CGIL Calabria, of Cosenza and the Pollino, express immense satisfaction for the historic sentence issued today by the Court of Cosenza, a work section, which declared the anti-union of the conduct of the three Emme cooperative society, condemning it to immediately cease illegitimate behavior and to remove its effects.
A praise and special thanks go to our defensive college, composed of the lawyers Giuseppe Peluso and Rosanna Pupo, who with exceptional competence, tenacity and passion have been able to translate into a winning legal action the right claims of workers and the union, obtaining a measure that restores legality and dignity. The work judge, Dr. Alessandro Vaccarella, accepting the appeal presented by our union organization, recognized the anti -union nature of a plurality of shares put in place by the company. The Court ordered the Tre Emme Soc. Coop. the immediate cessation of these conduct and the removal of their effects.
This extraordinary result would not have been possible without the courage, determination and compactness of the workers and workers of the Tre Emme, in particular of our members and our delegates and company union representatives (RSA). Despite an atmosphere of clear hostility, intimidation, discriminatory layoffs and unacceptable pressures, they kept their back straight, continuing to believe in justice and in the value of the collective trade union action. Our greatest thanks and our deepest admiration goes to them.
“This sentence is not only a victory for Filt Cgil, but for all workers and for democracy in the workplace,” Salvatore Larocca, secretary general of the Filt Cgil Calabria, and Giovanni Angotti, secretary of the Filt Cgil Cosenza, are jointly. “The Court put a firm point against the arrogance of a company that thought it could unravel fundamental rights impunity, such as union freedom and the right to strike. It is the demonstration that the struggle pays and that the unit of workers, supported by a serious and competent union action, is the only real weapon against injustices. We will not stop here: we will watch with the utmost attention so that the Tre Emme obtained at every point of the sentence and correct restorations and respectful industrial relations ».
Filt and CGIL will continue to be alongside the workers of the Tre Emme and all the productive realities of the territory and Calabria to ensure full respect of the contracts, the law and, above all, the dignity of those who work.
