After the annulment of the Court of Cassation, the Ferrara TdL, in accepting the review proposed by the defence, annulled the maxi seizure of the Emilian concessionaires, with the consequent return of all the assets. The two well-known companies, operating nationally and internationally, had been involved in a vast investigation into alleged tax crimes, which was extended by the European Public Prosecutor’s Office (EPPO) throughout the national territory and abroad.
However, last March 17, the Court of Cassation, accepting the appeal brought by lawyers Alberto Bova of the Court of Ferrara, Marco Gemelli of the Court of Reggio Calabria, Massimiliano Parpiglia of the Court of Ferrara and Bruno Salernitano of the Court of Bologna, defenders of the companies and managing directors of the companies involved in the investigation, had annulled the order of the Review Court which had confirmed the preventive seizure decree issued by the investigating judge of the Court Emiliano for tens of millions of euros.
The facts date back to last September, when the GdF’s investigations, coordinated by the European Prosecutor’s Office of Bologna, targeted companies that sold prestigious cars such as Ferrari, Lamborghini, Porsche and Bentley throughout Italy and also in Calabria. The decision of total release from seizure by the Review was welcomed with great satisfaction by the appellant companies, «which – explain the lawyers. Marco Gemelli, Alberto Bova, Bruno Salernitano and Massimiliano Parpiglia – expect to be able to resume their business in the shortest time possible, which had in fact been suspended following the seizure”.
