Also in Sicily the functions of administrative police will be transferred to the municipalities as it already happens in the rest of Italy. The Council of Ministers, in the last session, has in fact given the green light to the scheme of the legislative decree approved by the Schifani government in January 2024.
The bill contains the implementation rules of paragraph 4 of article 31 of the Sicilian Statute which provides for the transfer to the municipalities of the administrative police functions and, in particular, refers to the provisions of articles 68 and 69 of the Consolidated Law of the Public Security Laws (approved with Royal Decree 18 June 1931, n.773) which concern the release of licenses for the performance of shows, public events and similar activities by the local authority.
“Finally, from today, these functions will also be transferred to local authorities, as happens in the regions with ordinary statute since 1977 as a result of a decree of the President of the Republic – says the President of the Sicilian Region, Renato Schifani – the ruling of the Constitutional Court, which in 2023 intervened in favor of the transfer, gave a further input to the approval process of the implementation rules of the statute that arise from the need to apply the forms of simplification as for the forms Authorizations, licenses and concessions, which have so far been the competence of the state public authority in Sicily ».
The DDL, consisting of 5 items, specifies that the transfer does not determine additional charges against the Municipalities or the same region, since the new functions can be assimilated to the municipal authorization proceedings ordinarily managed by the staff in service. Furthermore, the measures adopted and reports received will still be communicated to the territorially competent prefect, which will have a power of suspension or cancellation for motivated public safety needs.
