On September 19, 2025, the Court of Appeal of Catanzaro, the third criminal section, pronounced a sentence not to proceed against Mariano Mamone, sentenced at first instance by the collegial court of Vibo Valentia in the third truncation of the procedure started on the impulse of the Public Prosecutor of the Republic of Catanzaro against various suspects accused of child prostitution in the context of an investigation taken in the Vibonese area by Vibo Valentia in the summer of 2016.
Mamone had been held responsible for the case referred to in Chapter B) of the charge, that is, a series of hypothesized induction attempts to child prostitution against two boys at the time minors.
Already in the initial phase of the procedure, at the end of Mamone, at the time defended by the lawyer Mario Bagnato, the Court of freedom of Catanzaro, in revoking the precautionary measure at the time applied to the same, had considered the declarations of the offended people not such to integrate the contested crime of attempted sexual violence.
The serious accusations, although considered conflicting by the Court of Liberty, were still judged founded by the collegiate court of Vibo Valentia who, on 8 March 20222, had sentenced Mamone Mariano to the sentence of three years and six months of imprisonment and € 4,000.00 on a fine.
The appeal trial, in which the Mamone was defended by the lawyer Francesco Matteo Bagnato, son of the previous defender who died in the blackberry between the first and second degree judgment, began in October 2024 and, after a series of hearings, ended today with the ruling not to proceed issued by the third section of the Court of Appeal of Catanzaro.
The defense focused on the arguments in support of the Mamone’s innocence with respect to all the accusations for the same as the result of a narrated contrasting between the different versions of the at the time offended people
At the hearing of 9 July 2025, the Prosecutor General had asked for confirmation of the sentence issued against Mamone Mariano.
Finally, to prevail, was the subordinate thesis supported by the lawyer Francesco Matteo Bagnato on the basis of which, since it is a possible conduct stopped only to the threshold of the attempt to induction to juvenile prostitution, the provision that provides for the doubling of the prescription terms pursuant to art. 157, sixth paragraph, cp on the basis of the provisions of the jurisprudence of the Court of Cassation (see Cass. Section III n. 35404/2016).
With this ruling, therefore, the judicial ordeal of Mamone Mariano ends in a positive way to the time subjected to a real media pillory for the serious accusations moved against him.
