The Court of Appeal of Catanzaro – Prevention measures section, at the outcome of the hearing of 14 July 2025 and during the postponement from the Cassation, revoked the confiscation of anti -mafia prevention ordered on January 16, 2023 by the Court of Catanzaro against Francesco Iannazzo. The provision concerned two land owned by the interested party on which an illegally built property insisted. The Court ordered the return of the assets.
The legal motivations
According to the appeal judges, the assets are of legitimate origin. Furthermore, by accepting a law profile already enhanced in legitimacy, the Court clarified that the presence of a totally abusive property does not determine asset increase and, as such, cannot constitute a reason for confiscation.
