The Sim Carabinieri expresses satisfaction with the positive outcome of an appeal presented by a superintendent of the force, at the time of the events in service at the provincial command of Vibo Valentia and union leader of the same organization.
The matter, followed by the national and regional legal department of the union with the patronage of the lawyer Achille Morcavallo, ended with the annulment of the disciplinary measure previously adopted against the soldier.
“Serenity restored to an esteemed colleague”
The hierarchically superior authority accepted the appeal in its entirety, recognizing the validity of the objections raised by the defence, relating to the lack of preliminary investigation, the disproportionality of the sanction and the violation of the right of defence.
“This pronouncement represents a fundamental act of justice”, declared the regional general secretary of the SIM Carabinieri Calabria, Giuseppe Grillo, underlining how the decision restores serenity to “an esteemed colleague, unjustly affected”.
Privacy and protection of personal data
The case also had relevance in terms of privacy protection. In fact, the right to have references to previous disciplinary cases concluded without sanctions concluded without sanctions being obscured and unusable in administrative proceedings has been recognised.
According to lawyer Morcavallo, this is an important result also for possible future applications in disciplinary proceedings regarding personal data.
