Former Ilva of Taranto, the Council of State allows the continuation of the activity

The Council of State allows the continuation of the activity of some production plants, including that of the former Ilva in Taranto. We read it in a note. «With ordinance no. 3992 of 4 November 2025, the Council of State dealt with the legitimacy of an act issued on 7 September 2023 by the independent authority competent for electricity, gas and water (ARERA). With this act (concerning the activity carried out by the Acciaierie d’Italia spa in some plants, including those in Genoa, Novi Ligure, Racconigi and the former Ilva in Taranto), – it is explained – ARERA had set a deadline for the company to identify the supplier of the gas necessary for the continuation of production activities and the methods of its transport”.

“The company – complaining about the excessive brevity of the deadline set by ARERA – had challenged this act before the TAR for Lombardy, which with sentence no. 3104 of 2025 rejected the appeal. – it is added – In examining the appeal of the Acciaierie spa, with the aforementioned order no. 3992 of 4 November 2025 the Second Section of the Council of State accepted its precautionary request, has suspended the enforceability of the TAR ruling, allowed the continuation of the supply, to avoid the interruption of the production activity carried out in the plants of national strategic interest and the consequent damage to employment, and at the same time set the hearing for 9 June 2026 for the definition of the second degree of the judgement”.
