The government’s choice to write the final word on the Calabrian health commissioner? A “political choice which determines its unquestionability during the preventive control of legitimacy”. Hence the decision of the Central Section of the legitimacy control of the Court of Auditors on the Government’s acts in declaring there is no need for a ruling on the decision which closely concerns this region.
The reasons for the decision which appeared on the institutional website of the Court of Auditors, however, do not resolve all the doubts even if they contribute to strengthening a thesis supported by the parties of the regional Citadel for several weeks already. The accounting magistrates maintain that the commissionership is not a simple administrative measure because it expresses the constitutional role of the Government in directing health policy. From this it derives its “connotation of political choice” and therefore its unquestionability in the context of preventive control. But in the same period he specifies that that power is characterized by “unavoidable presuppositions arising from technical checks”. And therefore: who checks that the unavoidable conditions exist?
