Illegitimate extensions, Sibari seaside businesses at risk

The apprehension of the Cassano seaside resorts continues, who say they are highly concerned about the current situation due to the recent rulings of the judges which would even put the future of the upcoming summer season at risk. The general extensions of state concessions to factories are also illegitimate because they conflict with the Bolkestein directives. The Council of State reaffirmed this this week with three sentences filed – and relating to the judgments subject to the decisions of the Supreme Court and the Court of Justice – reiterating the consolidated principles of its jurisprudence on the illegitimacy of generalized extensions of maritime state concessions for tourist-recreational purposes established by the legislator as they conflict with the principles of competition and freedom of establishment enshrined not only in the Bolkestein Directive, but also in Article 49 of the Treaty on the Functioning of the European Union. A situation that brings into play those exceptions that, essentially, the vast majority of municipalities (including that of Cassano) have already defined and authorized.
