Two people from Reggio, an entrepreneur and a professional, were acquitted by the Court of Milan of the serious accusation of fraudulent declaration and concealment and destruction of documentation amounting to over 5 million euros. Specifically, the judges recognized the non-involvement of the investigators’ objections – issuing a full acquittal sentence – against SN, legal representative of a well-known company operating in Lombardy in the field of renewable energy and the accounting consultant of the same company, also from Reggio Emilia, AR, accused, jointly, of fraudulent declaration (pursuant to Article 3 of Presidential Decree 74/2000) for over 5 million euros and of concealment or destruction of accounting documents (pursuant to art. 10 of the same law which punishes the crime with a sentence ranging from 4 years to 8 years of imprisonment in addition to preventive seizure for equivalent).
After a long and intense investigative activity, the lawyer Marco Gemelli of the Reggio Bar, defender of both defendants, managed to demonstrate how the accusatory hypothesis was unfounded “due to the complete extraneousness of the two defendants to the facts”.
And in fact, during the trial, which saw texts from the prosecutor’s office and the defence, the defendants had the opportunity to counter the arguments explained by the investigators and therefore overturn the prosecution’s theory which was the basis of the request for a significant prison sentence which, if imposed, would have led to serious difficulties for the defendants with respect to the entrepreneurial and professional field in which they operate.
Great satisfaction was expressed by the defense “also because the favorable outcome of the proceedings concerned well-known subjects in the field of Milanese entrepreneurship”.
