Lamezia, anti -corruption plan, no omission from the Mascaro junta

The Court of Catanzaro (first civil section) canceled the resolution with which the ANAC (the National Anti -Corruption Authority), in February 2021, had fined the members of the era of the junta Mascaro – which at the time of the sanction had been suspended by the TAR – for theOmessa adoption of the 2020/2022 anti -corruption plan, noting that it was only the failure to update the tool.

The judges therefore considered the reasons of the mayor founded Paolo Mascaroof the deputy mayor Antonello Bevilacqua, of the councilors Sandro Zaffina and Luisa Vaccaro, of the former councilors Giovanni Francesco Luzzo, Teresa Bambara and Giorgia Gargano, as well as of the former general secretary of the Municipality, Pasquale Pupo, defended by the lawyers Dina Marasco and Francesco Bevilacqua.

The judge also sentenced the National Anti -Corruption Authority to the recasting, in favor of the applicants, of the judgment costs quantified in 8 thousand euros.

The sanction adopted at the time had been 1000 euros each and was the minimum required by law. In the resolution canceled, the Anac indicated that both the secretary and the junta were “aware of the non -fulfillment that was repeated for the second consecutive year”. Which, among other things, testifies that even in 2019 the plan was not updated, although there had been no provision against the commissioner triad in office at the time.
