‘Ndrangheta in Lamezia Terme, 19 convictions on appeal for alleged members or affiliates of the Giampà clan

The Court of Appeal of Catanzaro, second criminal section, presided over by Dr. Alessandro Bravin with judges Roberta Carotenuto and Maria Rosaria Di Girolamo, issued the operative part of the sentence in proceeding no. 1066/22 which involved twenty-four defendants, including several belonging to or presumed affiliated with criminal contexts linked to the Giampà clan.

The decision, which partially reforms the sentence issued by the GUP of the Court of Catanzaro on 21 June 2021, led to a redetermination of numerous sentences, some acquittals and revocations of accessory sentences.

Among the main decisions, Danilo Cappello and Gabriele Caruso see their sentences redetermined to 2 years and 8 months in prison and a fine of 12,000 euros, with the revocation of the ban from holding public offices.

Francesco Cerra and Morrison Alessio Gagliardi will no longer have to answer for the crimes attributed to them due to the statute of limitations.

Antonio Giampà and Pasquale Mercuri acquitted because “they did not commit the crime”.

However, the penalties for some top exponents are heavier:

  • Davide Giampà, having recognized the continuation of a previous conviction from 2013, sees the overall sentence redetermined at 10 years of imprisonment;
  • Saverio Giampà sentenced to 15 years, 9 months and 10 days;
  • Domenico Giampà to 4 years in prison, with disqualification from holding public offices for 5 years.

For Luigi Notarianni, excluding recidivism and recognized prevailing generic mitigating circumstances, the sentence was set at 4 years, 5 months and 10 days of imprisonment, with revocation of probation and acquittal for the facts prior to 2008.

Claudio Paola was instead sentenced to 6 years and 8 months in prison.

The Court finally confirmed the sentences for Roberto Castaldo, Domenico Chirico, Andrea Crapella, Vincenzo Giampà, Bruno Malvaggio, Maurizio Molinaro, Aldo Notarianni, Carmine Vincenzo Notarianni, Pasquale Notarianni, Davide Orlando, Francesco Renda and Antonio Stagno, also ordering them to pay the legal costs.

Alessandro Torcasio’s appeal was declared inadmissible due to renunciation.

The panel set the deadline for filing the reasons for the sentence at ninety days.
