‘Ndrangheta in Vibo, Scott’s rebirth: the count of sentences returns to the Court of Cassation

Final chapter for the section with an abbreviated rite of Rinascita Scott, the maxi investigation into the ‘Ndrangheta of Vibo. The Court of Cassation has set the Council Chamber for November 24th to discuss the appeals against the bis appeal sentence issued in May by the second instance judges. A total of 28 positions for which the notice was issued. Among the heaviest names, according to the accusatory approach, Domenico Macrì known as “Mommo” and Francesco Antonio Pardea, indicated as points of reference for the “new generation”, Pasquale Gallone, and Gregorio Giofrè.

The basis of the new passage is the ruling of the Court of Cassation of 22 May 2025, which had partially annulled the previous appeal ruling. The judges had deemed the application, for these defendants, of the aggravating circumstance provided for in the sixth paragraph of the art. to be inadequately motivated. 416-bis, i.e. relating to the financing of economic activities to be controlled through the price, product or profit of crimes.

It was not a question of annulment of the entire accusatory system, but of a limited postponement: it was necessary to re-determine the sentences by removing the quota linked to the aggravating circumstance. Task fulfilled on 21 May 2026 by the Court of Appeal of Catanzaro, which explained that it had subtracted the increase for the aggravating circumstance and recalculated the continuation, without being able to call into question the already definitive basic sentence: 20 years for Luciano Macrì, 15 years and 2 months for Domenico Macrì, 14 years and 10 months for Gallone, 14 years and 8 months for Francesco Antonio Pardea. Then to scale up to 8 years, with two minor positions around 3 years. On November 24, therefore, the Supreme Court will decide only on questions of legitimacy. If he refuses, the penalties become definitive. If he agrees, he will be able to cancel and decide directly or refer it to another Appeals section.
