No new penalties, just a fine of 10 thousand euros. Messina negotiates

The National Federal Court, Disciplinary Section of the FIGC, has imposed a fine of 10 thousand euros on ACR Messina, a company currently in judicial liquidation. The decision was taken in the council chamber which met today. The proceeding originates from the referral of the Federal Prosecutor’s Office (n. 11033/1057pf24-25) in October linked to the failure to pay the agreed sum (in July) due to the failure to present the “knowledge” documents of the members of AAD Invest, who had assumed the majority of the old club in January 2004. However, they never presented the documentation to Coaps, which is responsible for evaluating the acquisition procedures and the solidity of the successors on behalf of Covisoc. Documents that Doudou Cissè’s company, recently declared bankrupt in Luxembourg, had never presented.
Before the opening of the hearing, the Federal Prosecutor’s Office and Messina presented a proposed agreement. The Court, having listened to the parties’ lawyers, deemed the classification of the facts correct and the proposed sanction appropriate, therefore declaring the agreement valid.
Accepting the joint proposal, the Court applied a fine of 10 thousand euros to the club and at the same time declared the proceedings closed. The decision was digitally signed by the president Carlo Sica, by the speakers Francesca Paola Rinaldi and Luca Voglino, and by the secretary Marco Lai. Defending Messina is the lawyer Luis Vizzino, former consultant of the club now in liquidation and who is also supporting Racing in the procedure linked to the federal takeover by obtaining affiliation.
