The Court of Auditors confirmed the seizure for only three of the 11 people involved in the investigation parallel to that already opened by the Public Prosecutor’s Office on the so-called Scorcia System. Precisely for the doctor and university professor Vincenzo Scorcia the jurisdictional section confirmed the seizure for a value of 3,876,166 euros. In the confirmation provision the jurisdictional section writes: «The carrying out of unauthorized extra-institutional activities by Scorcia appears indisputable». According to the accounting judiciary, there was “obvious malice” in the behavior of the ophthalmologist, who had “repeatedly violated the sector regulations underlying his employment relationship, to the point of concealing from the damaged administration the performance of the illicit extra-mural activity”. On the contrary, as regards the use of healthcare equipment and public facilities, according to the jurisdictional section “there is no evidence whatsoever of the receipt of illicit compensation by Scorcia and, therefore, the complained of “twisting” the public interest in favor of the private one, and, in any case, any other prejudice to the finances of the healthcare administration”.
The seizure of 227,778 euros for Giuseppe Giannaccare, defended by the lawyer Pasquale Melissari, has been confirmed. The associate professor of surgical sciences at the Umg and assisted in the Ophthalmology department of the Dulbecco company, starting from the end of 2020, would have continuously carried out extra-institutional activities in favor of clients and private clinics. Furthermore, he allegedly misappropriated medical supplies, having performed 70 surgeries for the implantation of intraocular lenses. Even in his case, according to the judges, “the university professor’s desire to realize his exclusive economic interest is clearly evident”. Finally confirmed the seizure of 80,622 euros against Adriano Carnevali, (defended by the lawyer Alfredo Gualtieri) fixed-term university researcher at the department of medical and surgical sciences of the UMG and member of the medical team of the ophthalmology department.
However, the seizure for Maria Battaglia, Laura Logozzo, Andrea Bruni, Eugenio Garofalo, Rocco Pietropaolo, Andrea Lucisano, Giorgio Randazzo and Maria Aloi was cancelled. The lawyers Francesco Iacopino and Crescenzio Santuori for Professor Garofalo and the lawyer Enrico Morcavallo for Professor Bruni commented: «The conditions for the adoption of the precautionary measure were considered completely non-existent».
