A judge has canceled the trial in the case of an American woman who killed her three children, but left his decision pending to allow for a possible appeal. Judge William Sullivan said he would freeze his nullity ruling in Lindsay Clancy’s trial for an hour to allow an appeal to a higher court. The jury is deadlocked at 11 to 1, and the majority appears inclined to find Clancy not guilty on grounds of mental health.
Unanimity of the 12 jurors is needed
To reach a verdict, all 12 jurors must agree. If they can’t reach an agreement, the judge declares a mistrial and prosecutors must decide whether to retry the case with a new jury.
