First fine of the European Antitrustust to Anti -Concrhregial agreements at work and in particular to understanding so as not to “blow” employees offering them better salaries: one Maxi penalty of 329 million euros It was imposed on two giants of the “Takaway”, the German Delivery Hero and his Spanish subsidiary Glovin. According to Brussels, they created a sign between 2018 and 2022 by agreeing in detail on the most disparate commercial information of delivery’s activity, from the markets on which to focus, at prices. It is “the first time that the Commission sanctions non -employment agreements, in which companies stop competing for the best talents and reduce the opportunities for workers”, underlined the vice -president of the EU Commission Teresa Ribera.
For the first time, then, Brussels intervenes on “an anti -concurrent use of the minority share of Delivery Hero in Glovo”, explained Ribera. When the German group had entered the capital of the Spanish platform, a parasocial agreement had been signed, but the agreements gradually enlarged. The sign lasted since Delivery Hero has taken on the first share in 2018, until he took full control of Glovo in 2022. Both companies admitted responsibilities by accepting the fine. A year ago Delivery Hero, listed in Frankfurt, had also announced provisions for 400 million for the possible fine and now stressed that the final amount is lower. The agreement will allow the two companies to “proceed quickly”, he said, reiterating “the commitment to maintain a culture of conformity throughout its organization and to operate responsibly and ethically in the highly competitive sector in which it operates”. The fine for the only delivery Hero (12.8 billion of turnover 2024), is 223 million, while it is 106 million for Glovo (over 1 billion 2024 revenues in what defines the ‘Quick Campe). The investigation was launched by the commission on its own initiative, and not on a competitor’s complaint, supported by “a solid material”, explained a European official. A kind of school case, given that the two participants in the cartel continually shared with chat on WhatsApp the respective corporate strategies or protested by email with each other to have “violated” the agreement not to hire to conquer the employees.
