The place of work in the Aeolian Islands is incompatible with her state of health and for this reason she must immediately be transferred to a place from which, in case of need, access to hospital care is easier. This is what was established by the judge of the Court of Barcelona, Claudia Giovanna Bisignano, who accepted the appeal of a Poste Italiane employee working at the counter on one of the Aeolian islands. The worker, as represented by her lawyer, the lawyer Massimiliano Fabio, is suffering from a pathology recognized as a serious disability for which, according to what emerged from the documents produced, the destination is incompatible with her health conditions. The judge noted the risk of imminent and irreparable damage, because staying on the island would not guarantee timely access to hospital facilities. With an “unheard of alter party” provision given the urgency, and recalling law 104, pending the hearing on the merits, the company was ordered to arrange for the immediate transfer of the woman to an office near the residence, in a center in the Nebrodi area or in any case a place that allows her to reach the hospital quickly.
