Fernando Cluster, 62, is suing Emory University Hospital in Atlanta after part of his skull was removed during emergency surgery following a brain hemorrhage.
When Cluster returned to the hospital two months later to complete the operation, he discovered that the bone fragment had not been preserved as expected. Due to this negligence, he had to endure a delay in the surgery and an expensive synthetic implant, which later caused an infection, requiring another operation.
The hospital also charged Cluster and his insurance for the error, bringing the total costs to more than $146,000.
The man is now demanding compensation, fearing further medical complications.
