The Civil Appeal Court of Messina sentenced the regional deputy of South Calls North and mayor of Taormina, Cateno De Luca, to pay 9,000 euros in damages to a family from Fiumedinisi, plus 6,327 euros in legal costs, for defaming them during the rally on 4 March 2012. In criminal proceedings he had been sentenced at first instance, in 2018, to a fine of 1,800 euros, reduced on appeal in 2020 to 200 euros, while in 2022 the Cassation quashed the sentence without postponement due to the statute of limitations of the crime, referring it to the Court of Appeal for the re-evaluation of the justification for the right of criticism. The judges established that the terms “slanderous accusers” and “cheaters” used by De Luca have no denigrating and defamatory value, while the term “bastards” has “an intolerably defamatory value” and it was “a gratuitous verbal attack on the moral sphere of others and of useless mockery or personal contempt”.
