The extension of the deadline for submitting applications for the renewal of seaside concessions in the Sicily Region is illegitimate. The Constitutional Court has decided this with a ruling. The issue was raised by the government, which accused the Sicilian legislator of having exceeded its powers by violating the Bolkestein directive. The postponement of the deadline to 30 April 2023, according to the government, “corroborates the extension of maritime state concessions until 31 December 2033”, despite the fact that the state law had repealed the extension until that date in 2022. The Court therefore noted that renewing the possibility of submitting applications “ends up affecting the regime of duration of ongoing relationships”, perpetuating their maintenance and therefore strengthening “the barrier to entry for new economic operators”.
