The discussion before the Review judges on the “Cuzzocrea case” is taking place in Messina. At the end of the hearing, the lawyers Giorgio Perroni and Elena Florio sent a note: “The defense – the lawyers write – has provided documentary evidence of the non-existence of the precautionary requirements invoked by the Prosecutor and referred to in the appeal documents. In the brief filed, the defense, in fact, objected to the inadmissibility of the Prosecutor’s appeals due to violation of the “ne bis in idem” principle, also given the unusability of the investigations recently carried out (on which exclusively are the basis for the said appeals), due to the expiry of the duration of the investigations, in any case and for the sole purpose of dispelling any doubts – they continue – Prof. Cuzzocrea has also asked the University of Messina to withdraw from the “Chibiofarm” department and to be transferred to another university said new elements, provided by the defense – conclude the lawyers – empty the Prosecutor’s requests for the application of the precautionary measure even more of any content.
In the coming weeks, the defense will examine, also through a consultant, the mass of investigative documents, of which it received copies a short time ago, in order to demonstrate the position and correctness of the actions of its client”.
