The judgment remains suspended. In the meantime, a new legislation has intervened. In the background the story relating to the instability of the Municipality, referring to the year 2019. The Court of Auditors had asked for pecuniary sanctions for the former mayor, Mario Occhiuto, today Senator, and 17 other people, including some former councilors.
And this in relation to an alleged damage caused to the speakers of the entity, in application of art. 248 of Legislative Decree 267 2000 (Consolidated Law of Local Authorities), which provides, for condemned administrators, also an ineligibility for the duration of ten years.
Well, there would be a novelty in the procedure started by the Regional Prosecutor of the Court of Auditors, against Occhiuto and the other 17 people for the assessment of any responsibilities in the instability of the Town Hall.
In practice, by virtue of a modification that occurred in the regulatory device published in the Official Gazette, the sanctions, net of the case of willful misconduct, would not be applied against those administrators who have adopted the multi -year financial rebalancing plan within two years from the settlement of their first mandate. And in this context, Occhiuto would return, who, elected in 2011 at Palazzo dei Bruzi, adopted the rebalancing plan in 2013.
