A 59-year-old man, Rocco Modaffari, currently under house arrest, was sentenced today by the Bergamo court to 15 years in short for the murder of Roberto Guerrisi, killed at the age of 42 by gunshots last 28 December in Fornasotto di Pontirolo Nuovo (Bergamo) outside the Db Car company. The man had shot during a dispute between the respective families (originally from the province of Reggio Calabria). Madaffari was convicted of voluntary manslaughter, possession of a pistol with abraded serial number and receiving stolen goods. He was able to opt for an alternative procedure because no aggravating circumstances were contested that would bring the maximum sentence up to life imprisonment. The preliminary hearing judge Federica Gaudino recognized the mitigating factor of provocation by the victim. The prosecutor Giampiero Golluccio had asked for a sentence of 17 years and 8 months, while the defender, the lawyer Emanuele Occhipinti, had invoked self-defense and, alternatively, the classification as culpable excess of self-defence, however invoking the mitigating factor of provocation. The judge also ordered provisional compensation of 35 thousand euros to each relative who took the civil action.
