A flurry of releases is in sight for numerous convicts in the shortened part of the «Rinascita Scott» maxi-trial against the ‘Ndrangheta of the Vibonese area. In fact, the Cassation, in accepting an appeal brought by the lawyers Sergio Rotundo and Antonio Galati, ordered the annulment without postponement of the imprisonment order issued by the Catanzaro General Prosecutor’s Office against Domenico Cracolici, 38 years old, believed to be the boss of Maierato (Vv), sentenced on appeal to 10 years and 8 months, a sentence later annulled by the Cassation with postponement to appeal only for the redetermination of the sentence, pending the annulment of a aggravating factor in the crime of mafia association.
Following this annulment, the Court of Appeal of Catanzaro issued an execution order independently calculating the sentence to be carried out. Lawyers Rotundo and Galati then proposed an execution order against this provision, rejected on appeal, but now accepted by the Supreme Court which annulled without postponement declaring the non-enforceability of the sentence of the Court of Appeal of Catanzaro issued on 30 October 2023. Until the new second degree trial and then the possible appeal to the Supreme Court, therefore, the defendants who had previously obtained the annulment with postponement to the Supreme Court must be released from prison due to the expiry of the maximum terms of custody precautionary.
