The Messina Review Court has entirely annulled the preventive seizure decree issued against the owner of a company based in Reitano, in the Messina area, beneficiary of a contribution of approximately 83,500 euros as part of the National Recovery and Resilience Plan, Mission 2 “Green Revolution and Ecological Transition”, intended for the construction of a photovoltaic system.
The proceedings and the seizure
The original provision had ordered the seizure of sums of money and real estate available to the suspect up to the amount deemed to correspond to the profit from the alleged crime of undue receipt of public funds.
The investigation was started following investigations carried out by the Guardia di Finanza and coordinated by the Public Prosecutor’s Office of Patti, with particular reference to the actual exercise of the agricultural activity connected to the agritourism structure involved in the financing.
The defense’s argument was accepted
With the decision taken by the Review Court, the release and restitution of all assets subject to the precautionary restriction was ordered.
The judges accepted the defense arguments supported by lawyers Francesco Cutraro and Antonio Di Francesco, resulting in the termination of the precautionary financial measures adopted during the investigation phase.
In light of the ruling of the Review, the precautionary framework is completely superseded, with the annulment of the preventive seizure decree previously ordered against the entrepreneur.
