A 2.1 million euro sentence. A record, especially if we consider that the accounting judiciary, the section of the FVG of the Court of Auditors, to inflict it. The defendant is an unfaithful servant of the state which, used in the customs and monopolies agency (ADM)using a colleague’s computers and credentials (arrested at first then exonerated from all charges), he issued false acts attesting goods in non-EU export. Therefore on which there are no excise rights or VAT rights. The amount that will have to compensate, if in possession of the huge amount is equivalent to the amount of the tax evasion. This, in fact, relates to 15 false export bills issued by an employee, Francesco Condemi, today aged 63, from Reggio Calabria but residing in Trieste, between November 2017 and April 2018, when he worked at the transit service of the Franco Nuovo point in Trieste (in 2024 the man was fired without notice).
The mechanism is extremely simple: a manufacturer emitted an invoice in which he claims to have sold a stock of alcohol to an extra European country. However, the goods were never brought to customs but Condemi emitted the exit as if this had left for his destination. In this way the goods remained in the hands of the manufacturer who could sell it in black and a cost much lower than that of the market. It is not up to the accounting judiciary – which has the sole task of ascertaining and recovering any frauds to the tax authorities – identifying producer and any other people involved in the deal, must be the ordinary judiciary to instruct the investigation.
For the moment, however, The Court of Trieste issued a sentence only for the crime of abusive access to the computer system, instead fulfilling the man from the crime of slander.
CONDEMI, however, has already had to pay 160 thousand euros as compensation to the colleague of which he used computers and credentials. The latter had in fact arrested and also served a period of preventive imprisonment before his extraneousness to the facts was recognized. Transferred from Trieste, he started a dispute against Condemi who had to pay the amount requested. On the other hand, the movies of the cameras installed in the office are clear: when the colleague was absent, Condemi went to sit in his place and compiled the false acts, erasing the trace of the movements of the first to figure in the office.
