From preventive detention to stop violent people before they arrive in the streets to the restriction on knives for minors, up to the ‘shield’ but not only for the agents, but also for all citizens, and to the red zones. The rules ready to be included in the new security package range across multiple fronts and on which, in addition to the political ones, several meetings are currently underway between the technicians of the various ministries to analyze the measures in detail and decide which ones to include in the legislative decree and which ones in the bill.
The hypotheses on the table
On the table is the possibility for officials and police officers to detain in their offices, for a maximum of 12 hours – although Matteo Salvini would like them to be extended to 48 – people identified during preventive checks in view of demonstrations and deemed dangerous for the peaceful conduct of the demonstrations. Still in terms of public order, the strengthening of the urban daspo (Dacur) with the extension of the ban on access to urban areas to those reported or convicted of crimes committed during street protests. Alongside this there would be the possibility of deferred flagrant arrest of those who cause damage during demonstrations. Furthermore, among the measures under study, the criminal ‘shield’ but erga omnes, not only for the police forces, which provides for the non-registration in the register of suspects in the presence of “justifying causes” in the case of crimes (an FdI proposal filed in the Chamber provides for example that where a justification is discernible, the prosecutor must carry out preliminary investigations within 7 days before proceeding, if strictly necessary, with the registration in the register of suspects). Officers would therefore not be automatically registered in the register of suspects when they act in the performance of duty or in the legitimate use of weapons. For all citizens the measure would apply in cases of self-defense. But also zero tolerance on knives, with particular attention to minors with the introduction of the ban on the sale of blades to under 18s, even on the web. The violation is punished with a fine ranging from 500 to 3 thousand euros, increased up to a maximum of 12 thousand euros in case of repetition. The crimes for which the police commissioner’s warning can be applied to children aged between 12 and 14 will be expanded. In general, there is an absolute ban on carrying knives with blades larger than 5 centimeters and for all others without a justified reason. The text also introduces fines for parents who fail to supervise minor children responsible for acts of violence. It is then thought to give the possibility (now provided only in exceptional and urgent cases) to the prefects of identifying ‘red zones’ in areas characterized by serious and repeated episodes of illegality, where subjects reported by the judicial authority for crimes against the person, drugs or for carrying weapons cannot stay.
