Two acquittals and four redeterminations. This is the sentence of the first criminal section of the Court of Appeal of Catanzaro, judging following the cancellation of the Supreme Court of Cassation which on February 2 had canceled the sentence of conviction. In particular, the Court acquitted Nicholas Izzo (defended by lawyers Francesco Gambardella and Antonio Larussa) by the dispute of participation in the association dedicated to drug trafficking to “not having committed the fact” and from the accusation of the sale of drugs because “the fact does not constitute a crime”. Izzo had been sentenced to the abbreviated judgment at the first instance at 8 years and 4 months for participating in the association dedicated to drug trafficking in the context of the Cerra-Torcasio-Gualtieri gang and two fine crimes aggravated by the mafia facility. The sentence by the defenders has been contested, the Court of Appeal accepted the appeal of appeal only limited to the aggravating retention of the mafia of the conduct, which thus was excluded with the simultaneous decrease in the sentence to 7 years of imprisonment. Hence the appeal to the Court of Cassation, which then canceled with postponement to another section of the Court of Appeal. Now Izzo’s acquittal from all crimes, as well as the Court has also acquitted, “because the fact does not exist”, too Domenico de ritawhich at first instance was sentenced to 1 year and 8 months, in acceptance of the grounds of appeal by the lawyer Antonio Larussa. At first instance Domenico de Rita had been sentenced to the sentence of years one and 8 months of imprisonment, a sentence partially reformed by the Court of Appeal of Catanzaro, and then canceled by the Supreme Court of Cassation.
The Court of Appllo then redefined the penalty imposed to Antonio Gullo (defended by the lawyer Antonio Larussa) in 1 month of imprisonment in continuation with the Crisalide 1 sentence (in the previous degrees of judgment to the sentence of 3 years of imprisonment). Has re -determined, reducing it, the penalty inflicted on Massimo Gualtieri (defended by the lawyer Antonio Larussa) in 2 months of imprisonment constantly with the Crisalide 1 sentence. He re -determined, reducing the penalty imposed on Davide Belville (defended by lawyers Antonio Larussa and Michele Cerminara) in 2 years and 2 months of imprisonment in continuation with the Crisalide 1 sentence. Finally, he re -determined, reducing it, the sentence imposed on Giuseppe Galluzzi (defended by the lawyer Pietro Chiodo) continuously with other sentences of conviction.
