New appeal trial for two defendants in the “Black Book” trial, the shortened trial process which has already recorded notable acquittals. The Court of Cassation (fifth criminal section) annulled with postponement the sentence against Giuseppe Libri (defended by lawyers Giacomo Iaria and Davide Barillà) and Gianpaolo Sarica (defended by lawyers Attilio Parrelli and Michele D’Agostino). For the two of them, the supreme judges sent the documents back to the Court of Appeal in Reggio to hold a new trial on the double aspect of the sanctioning treatment and on the solidity of the accusatory framework. It will therefore be the third appeal trial for the last two defendants in the abbreviated procedure of the “Black Book” investigation. At the same time, the judgment against Giuseppe Zindato was defined.
The accusations
Under accusation are leaders and second lines of the modern generations of the Libri gang, which for the DDA would have its criminal range of action from the Cannavò stronghold to the Condera, Reggio Campi, Modena, Ciccarello, San Giorgio neighborhoods and in the hamlets of Gallina, Mosorrofa, Vinco and Pavigliana; and of the satellite group of “Borghetto-Caridi-Zindato”.
Previously, the first section of the Court of Cassation had annulled with postponement as many as five convictions on as many positions, among which that of Antonino Caridi (son-in-law of the late ‘Ndrangheta leader Domenico Libri) stood out, considered the top of the modern wing of the Libri gang. The aggravating circumstance of having acted with a view to and with the aim of supporting the activity of the gangs and the aggravating circumstance of having financed the association through financial activities have already been cancelled.
The main part of the “black book” operation is under discussion, currently in the Collegiate Court in the crucial phase of the examination of the defendants after the very long exclusion of the list of prosecution witnesses. Ordinarily, the defendants also include some political exponents who allegedly had contacts and complicity with the gangs. In various ways, the accusatory charges include mafia militancy and economic support for the families of detained affiliates.
