It was to be an area exclusively used for camping with caravans and prefabricated structures that could be easily dismantled, such as toilets, sinks, showers and a management room. Instead, the military personnel of the Carabinieri Forestale Nucleus of Melito Porto Salvo and Bagaladi, together with the military personnel of the Carabinieri Station of Bova Marina and the Mobile Nucleus of the Guardia di Finanza Company of Melito Porto Salvo, assisted by the military personnel of the Investigative Nucleus of the Environmental, Agri-food and Forestry Police of the Forestry CC Group of Reggio Calabria and of the Carabinieri Forestale Department of the “Aspromonte” National Park, in execution of a preventive seizure order issued by the GIP of Reggio Calabria, have placed seals on 105 prefabricated houses built inside a campsite, located in the Municipality of Bova Marina (RC), built in the absence of urban planning and building legitimacy, landscape authorization, clearance from the bodies responsible for the protection of the constraints falling within the area and in violation of the building indexes provided for by the Ministerial Decree of Cultural Heritage.
The buildings, in fact, stand on a maritime state-owned areacharacterized by landscape-environmental, archaeological and seismic constraints resulting in the indelible transformation of a portion of protected territory as it falls within a Special Conservation Zone, in favor of the private interests of a company operating in the hotel and tourism sector. The preliminary investigations judge, at the request of the Public Prosecutor’s Office of Reggio Calabria, ordered the seizure having deemed the existence of the fumus of the crimes referred to in articles 54, 55- 1161 of the Navigation Code, without prejudice to the principle of presumption of innocence and without prejudice to the assessments that must be made in the subsequent precautionary phases and possibly on the merits.
The investigation originates in the context of the extraordinary checks of the maritime state property ordered by the Provincial Carabinieri Command of Reggio Calabria. The concessions issued, over the years, allowed the owner to legitimately occupy 160 square meters of covered state property surface, compared to the 6000 square meters in fact, occupied without any authorization, the aforementioned, moreover, had been authorized to occupy approximately 10,066 square meters of uncovered state property surface, despite occupying, without title, the total surface of 11,528.68 square meters.
In fact, the owner of the campsite built over time 105 prefabricated houses, for approximately 6,000 m2, occupying the state-owned area for approximately 11,528.68 m2, for an extension that is significantly greater than that covered by the state concession, equal to 10,066 m2, all presumably in violation of the Navigation Code.
The aspects relating to the area’s location in a very high flood risk zone and those concerning the safety and health conditions of the places are currently being verified, so as to make the intervention of the Judicial Authority unavoidable.
The Judicial Authority has already initiated discussions aimed at evaluating the possibility of protecting the rights of third parties in good faith and verifying, in compliance with current regulations, the possible compatibility of the temporary occupation of the site concerned.
It should be noted that the present criminal proceedings are in the preliminary investigation phase, therefore any assessment must be considered on the basis of the current documents and without prejudice to subsequent assessments of merit.
