The police commissioner of Messina, Annino Gargano, as the Provincial Public Security Authority, adopted 11 distinct provisions of D.AC.UR., better known as “Daspo Willy”, and 2 oral warnings, after the investigative activity of the Anti-Crime Police Division of the Messina Police Headquarters, from which the social dangerousness as well as the high probability of repetition of the conduct by the interested parties emerged.
In fact, according to the investigations carried out, the recipients of the measures took part in episodes characterized by violence and absolute disregard for the rules of civil life, constituting a real danger to public order and safety. More specifically, the first 5 “Daspo Willy” were adopted against the perpetrators of a fight between several people, which took place last April outside a public place located in Milazzo, in the crowded area of the city’s nightlife, in the presence of numerous patrons, witnesses – in spite of themselves – of the deplorable episode. The phases of the fight were filmed by the video surveillance systems present in the area and allowed the carabinieri of the local company to identify the subjects and refer them to the judicial authorities. Subsequently, against them, the police commissioner adopted measures prohibiting access and parking in the vicinity of the premises in the area of via Pescheria and in the surrounding streets, for periods of between 1 year and 1 year and 6 months.
A similar situation took place at the end of last August in Vulcano, where an equally violent brawl involved 4 subjects, all recipients of “Daspo Willy”. The fight arose from an argument that started inside a restaurant on the island, between the owner and some customers, which then degenerated outside the restaurant. Following what happened, the protagonists of the brawl suffered injuries reported with a prognosis of between 6 and 30 days. Following the intervention of the local police station, the subjects involved in the brawl were identified and reported to the Judicial Authority. The careful investigation carried out by the anti-crime division concluded with the adoption of measures by the Police Commissioner, which prohibit the aforementioned persons from accessing some public businesses located in the Port of Levante on the island of Vulcano, as well as from staying in the immediate vicinity, for a period of 1 year. The owner of the restaurant was also formally warned by the Police Commissioner, risking – in the event of recurrence of violent conduct – the suspension of the restaurant business pursuant to art. 100 of the TULPS
In the same context, towards two of the subjects reached by the provision, already burdened by criminal and police records for crimes against property, against the person and in the field of drugs and weapons, the police commissioner of Messina also adopted the prevention measure of the oral warning, warning them to conduct themselves in compliance with the law.
Finally, a further 2 “Daspo Willy” were issued against those responsible for two separate attacks which occurred in public places, Galati Mamertino and Capizzi respectively. The recipients of the measures were banned from accessing and parking in the immediate vicinity of the public places where the attacks were committed and the nearby businesses for a period of 1 year.
