The Regional Administrative Court for Calabria has canceled the awarding of the contract for the armed security services of the “Renato Dulbecco” University Hospital of Catanzaro, initially awarded to the POL Service company.
With a sentence filed today, the TAR – First Section (president Mastrandrea, speaker Levato, member Palmisano) – accepted the appeal presented on behalf of Sicurtransport by lawyers Alfredo Gualtieri and Demetrio Verbaro.
According to what is stated in the decision, the appellant company “complied with the requirements of the tender regulations”, which provided for the presentation of two separate files and the inclusion, in the one called “Technical Offer”, of the actual value of the offer.
The TAR recognized that this conduct generated “a reasonable and legitimate expectation on the part of the exponent on the regularity of the procedure”, thus rendering illegitimate the act of exclusion of Sicurtransport, which before the exclusion was at the top of the ranking in terms of scores.
In light of the decision, the administrative judges also ordered costs to be borne by the hospital and the opposing company.
