Elections in Calabria and seats, “We Moderates”: “Everything is in order with the attribution”

Maurizio Vento, delegate of the constituency lists of Noi Moderati, enters the debate on the interpretation of the electoral law that regulates the allocation of seats in the Regional Council of Calabria.

Vento intervenes to counter what he defines as “news aimed at ‘poisoning the wells'” and “unfounded theses regarding the interpretation of the electoral law”. To support his position, the delegate attaches a ruling from the Regional Administrative Court (TAR) for Calabria dating back to 2010, underlining how subsequent regulatory adjustments have not changed the substance of the distribution criteria, except for the values ​​of the thresholds.

“The sentence, pronounced by the TAR Calabria, First Section, on 19 July 2010, concerned an appeal presented by Giuseppe Morrone (RG 548/2010) against the Calabria Region and other electoral offices.
The appellant contested the minutes of the district central offices, arguing that, for the purposes of determining the electoral quotients and the consequent distribution of seats, the votes expressed for the presidential candidates (regional list) should also have been considered.

According to the appellant, a correct interpretation of the art. 15, paragraph 3, letter. ae lit. b, of Law no. 108/1968, should have led to the inclusion of these votes, with the consequent exclusion (due to failure to reach a quorum) of some lists and his proclamation as regional councilor.
The TAR, however, rejected the appeal as unfounded, deeming the appellant’s interpretation “incorrect”.

The judges established that, although the Central Office must determine both the electoral figure of each provincial list and that of each regional list (Art. 15, paragraph 3, letter a), “each of them is determined separately, for its own purposes”.

In conclusion, the TAR had already confirmed the correctness of the operations of the electoral offices, establishing that “the votes attributed to the presidential candidates (regional list) do not contribute to the determination of the district electoral quotient”.
