All the accused acquitted “because the fact does not exist”. This is the outcome of the first degree trial before the Collegiate Court of Lamezia Terme (President Angelina Silvestri, alongside Rosario Aracri and Sabrina Marasco) against Giuseppe Notarianni (defended by the lawyer Aldo Ferraro), Carmen Bonafè (defended by the lawyer Aldo Ferraro), Aldo Notarianni (defended by the lawyers Viscomi and Trasimeno), Giuseppina Giampà (defended by the lawyers Viscomi and Trasimeno), Pasqualina Bonaddio (defended by the lawyer Francesco Gambardella) and Rosa Giampà (defended by the lawyer Antonio Larussa), accused of extortion aggravated by the mafia method and with the aim of facilitating the Giampà mafia gang of Lamezia Terme.
After a detailed preliminary investigation in which almost all the justice collaborators of the Lamezia area were heard, in addition to the carabinieri of the Investigation Unit of Lamezia Terme and after the examination and cross-examination of the offended person, at today’s hearing the Prosecutor’s Office deposited all the sentences pronounced over the years with respect to the mafia gangs operating in the Lamezia area, as well as those which considered the credibility of the justice collaborators questioned. At the outcome of today’s hearing, the Public Prosecutor of the Anti-Mafia District of Catanzaro therefore asked for the sentencing of all the accused to 9 years and 4 months of imprisonment each, considering them all guilty of the crime they were accused of, highlighting the convergent statements of the collaborators of justice, who found the offended person.
The defenders of the accused then intervened, the lawyer Aldo Ferraro for Notarianni Giuseppe and Bonafè Carmen, who highlighted the non-existence of the disputed fact having regard to the same declarations made in the trial by the offended person, which described a different fact compared to the crime as contested against the accused, not at all confirmed by the generic declarations of the collaborators of justice, who reported nothing on the fact in dispute today. The lawyer then intervened. Larussa for Giampà Rosa, who highlighted the implausibility of the complainant’s statements and the generic nature of the accusation.
In the end, the Court, after deliberation, acquitted all the accused “because the fact does not exist”, reserving 90 days for filing the reasons.
