Parental leave, two months paid at 80% in 2024: the instructions in the INPS circular

Within six years of the child's life (or from the entry into the family of the adopted minor), employed parents will be able to have up to two months of compensated parental leave to80%.

The number of months of leave to which you are entitled will not increase, but only the allowance for one of the months. The application must be submitted to INPS electronically or via the Contact Center or the charities.

In practice, the couple has the right to 10 months of leave which can be increased to 11 months in the event that the father abstains for an entire or fractional period of no less than 3 months to be taken within the 12 years of the child's life or within 12 years of the entry into the family of the minor in case of adoption or foster care.

The family leave for the couple (or for the parent only in the event of death) it is compensated in the first six years of the child's life for the first month to80%. The second is paid to 60% (80% only in 2024) always in the first six years of the child's life or from entry into the family while the following seven months are eligible for compensation 30%regardless of the income situation, within 12 years of the child's life.

The additional months to which one is entitled are not compensated, unless the parent concerned has an individual income lower than 2.5 times the amount of the minimum pension paid by the compulsory general insurance (1,496 euros gross per month). In this case they are eligible for compensation 30% of salary.

Each parent has the right to three compensationable months (a period not transferable to the other parent) while both parents are also entitled to a further compensationable period lasting a total of 3 months, which can also be used in a way shared between the parents, within the individual limits of the individual parent and within the couple limit of 9 months eligible for compensation.

The INPS clarifies that the rule only concerns parents who end (even for just one day) their maternity leave or, alternatively, paternity leave after December 31, 2023. This, he explains, “is not a condition for the right to increase the parental leave allowance for a further month, but rather an initial deadline for the new provision to take effect”. In the case of a child born on 20 November 2023 and parental leave requested by the father from 21 November 2023 to 20 January 2024, the Institute explains by presenting some examples, the month of parental leave from 21 November 2023 to 20 December 2023 is compensable to the '80% of remuneration (as required by the 2023 Budget Law). The period of parental leave from 21 December 2023 to 31 December 2023 is compensable to 30% of the salary while the period of parental leave from 1 January 2024 to 20 January 2024 is compensable to80% of remuneration (as required by the 2024 Budget Law). Parents have 10 days of parental leave which can be compensated at80%if used by 2024, otherwise at 60% if used from 1 January 2025 and by the child's 6th birthday.
