The dispute over the public lighting system established in recent years by the company “Artec Esco Srl” ends with a conviction for the Municipality, which has seen its claims recognised, albeit partially.
The company, which in 2023 asked for the termination of the procurement contract for interventions aimed at improving the energy efficiency of lighting systems, aimed to condemn the organization to compensation for damages in the amount of 248,193 euros for emerging damage and 387,500 euros for lost profits, for a total of 635,693 euros.
The Arbitration Board, established to resolve the issue, expressed itself with an award that has become final, condemning the Municipality of Taormina to pay the sum of 366,414 euros, of which 258,009 euros for capital damages, 30,476 euros for legal interests from 2020 to 2026, 57,349 euros for operating expenses of the board, 19,136 euros for legal expenses to the company and other expenses.
The amount was recognized as an off-budget debt by the city council, with seven votes in favor from the majority, three against from the minority (Nunzio Corvaia, Lucia Gaberscek and Marcello Passalacqua) and the abstention of Maria Rita Sabato; absent except Brocato, Luca Manuli and Andrea Carpita.
An affair on which the opposition could return to ask for clarification, as Corvaia implied in the chamber. “Artec Esco Srl”, based in Taormina, has as sole director Eng. Davide Maimone and is owned by “Eledia Holding Srl”, a company owned by Maimone himself: until 2021 its sole shareholder was “Artec Associati Srl”, of which Eng. was administrator, legal representative and technical director from 2014 to 2021. Massimo Brocato, right-hand man of Mayor Cateno De Luca since 2023 and current president of the investee company Patrimonio Taormina.
