“Uniamo Acquaro” list, the Council of State rejects the appeal: Giuseppe Barilaro definitively out of the electoral competition

“Uniamo Acquaro”, a list with the outgoing Giuseppe Barilaro as candidate for mayor, whose previous municipal administration was dissolved due to mafia infiltration, is definitively out of the electoral competition on 23 and 24 November. This was established, after the district electoral commission which had rejected the list, and the TAR which rejected the appeal against this decision, it was the Council of State, which definitively ruled on the appeal proposed to it.

These are the summary reasons: “the certainty that the signatories have supported a list composed of certain candidates must be obtained from documentary and contextual elements of the presentation of the candidatures and cannot be deduced from phenomenal evidence, such as the objective context of the procedure relating to a small municipality, from pure chance, such as the participation of only two lists in the electoral competition or the filing of the lists at different moments in time, or, even, from subsequent events, such as the substitutive declarations made ex post by the signatories and by the employee in charge of the authentication functions by the Extraordinary Commission”.

There were three reasons why the list was rejected and subsequently also rejected by the TAR, which deemed only 2 sufficient: absence of the list mark on the candidate presentation form; placing the presenters’ signatures on loose sheets of paper not physically connected to the main form and without the list mark; lack of date in the act of authentication of the signatures of the subscribers. Strange for people with experience in this sense. Now the opponent is the quorum. Or rather, the full awareness of residents whether it is better to have a new administration or a new commissioner. The fourth since 2010. Always caused by the same perverse thought, which establishes that it is legitimate to play with the institutions.
