‘Ndrangheta, Operation Acquarium: the Supreme Court cancels the prison sentence for Domenico Fusca

This evening the Court of Cassation ordered the annulment without postponement of the precautionary custody order in prison ordered by the Catanzaro investigating judge against Domenico Fusca accused in the Acquarium proceedings for the crime of participation in an association aimed at drug trafficking and of two hypotheses of possession of a large quantity aggravated by the purpose of the mafia-style facilitation. The appeal of the lawyers Sergio Rotundo and Alice Massara who had challenged the provision of the Court of Freedom of Catanzaro which had fully confirmed the precautionary custody order in prison issued by the District Magistrate was accepted. Fusca’s qualified participation in the association was contested as, in an accusatory perspective, direct contacts with Angelo Maiolo indicated as the promoter of the association had emerged. Today’s decision by the Legitimacy Judges completely cancels the two precautionary measures, ordering his immediate release which, however, will not have immediate effect as Fusca is still a defendant in the Habanero proceedings for which the proceedings are underway.
