The mafia aggravating circumstance is excluded and the documents are postponed for a new appeal process. This is the decision of the Court of Cassation on the brutal attack that occurred in 2022 against a young man from Catanzaro. Vitaliano Costanzo (sentenced in the second degree to 6 years and nine months in prison), Francesco Squillace, known as “Cecchetto (at 6 years) and Riccardo Elia, (6 years and 7 months) will return to the Court of Appeal. The defendants were variously accused of torture, aggravated personal injury, kidnapping, private violence, illegal possession of a common firearm, robbery. Both in the first and second degree the mafia had now held the aggravating circumstance excluded by the Supreme Court.

The facts contested and reconstructed by the Flying Squad would have occurred in October 2022. On the 26th and 27th of that month, the brutal attack against a boy who would have had a romantic relationship with Costanzo’s partner took place. According to the investigators, on 26 October the latter would have summoned the victim to his home, where with beatings, threats (even with a gun) and beatings he would have subjected him to an interrogation – which lasted from 5.30pm to midnight to make him confess to having had a romantic relationship with the woman, which he first denied and finally admitted after violent pressure. A picture of cruelty that would have been made even more disturbing by having asserted, as reconstructed by the magistrates, membership of the Gaglianesi gang.
