Justice Reform, the “It’s Right to Say No” committee is born in Messina: the risks for citizens

On 22 December, the territorial branch of the “It’s Right to Say NO” Committee was established in Messina, which elected coordinator, by acclamation, Luigi D’Andrea, full professor of constitutional law at the University of Messina.

The choice reflects the clear openness to personalities outside the judiciary, as reiterated by the designation of the lawyer in the board of directors. Aurora Notarianni and Dr. Vittorio Silvestro, doctoral student in public law.

Completing the executive body are magistrates Andrea La Spada, president of Anm Messina, Ornella Pastore and Salvatore Nucera, appointed communications manager.

The committee, open to the participation of civil society, intends first of all to inform, on a purely technical level and with the institutional posture typical of the judiciary, on the contents of the reform project and highlight those it deems the greatest risks.

First of all, that of the weakening of the autonomy and independence of the judiciary, starting from the function of the public prosecutor who, distanced from the judge and brought closer to the majority on duty, would like to be transformed into a “lawyer for the prosecution”, with a clear decline in citizens’ guarantees.

This very serious risk will then be accompanied by the continuing lack of efficiency of our procedural system, an issue that continues to be hidden by the fig leaf of yet another, not at all necessary – and indeed harmful, especially for those who are forced to turn to justice – attempt at constitutional reform, which should be handled with much more care.

Finally, the issue of the diversion of important financial resources which, instead of being allocated to the hiring of useful personnel to clear the backlog and thus provide faster responses to users, will be used to create further bodies (double CSM and disciplinary High Court), with all the consequent operating costs.

This is why the committee, which will be officially presented to the local community immediately after the holidays, is already promoting meetings and public debates, especially in cross-examination, with students, civil society and professionals, in the constructive spirit that has always animated its members
