The Court of Catanzaro – Prevention measures section has rejected The proposal made by the District Anti -Mafia Prosecutor for L‘Application of the personal and patrimonial prevention measure against Domenico Gallello, entrepreneur involved in the context of the “Impronimento” investigation.
Gallello had initially been convicted of fictitious header in favor of Rocco ring, alleged boss of the homonymous clan, and for an aggravated fraud against the municipality of Sant’Onofrio. Both crimes had been considered aggravated by the mafia concession and had led to the confiscation of the company “Gallello Domenico” and other companies attributable to the entrepreneur, active in the construction and agriculture sectors.
From the first degree, however, Gallello had been acquitted of the crime of mafia association, in relation to the alleged belonging to the so-called ring-flour consortium. The acquittal was definitively confirmed by the Court of Appeal of Catanzaro, which also reformed the first instance sentence, fulfilling the gallery by all charges, including those relating to the fictitious header and scam.
In the meantime, between the first degree and the pronunciation of appeal, the DDA had asked for the application of personal and patrimonial prevention measures. But the Court – at the outcome of the chamber investigation – established that there are no further elements compared to those already examined in criminal proceedings such as to experience a concrete functionality of the entrepreneur’s work on the interests of organized crime.
With decree dated 29 May 2025, the Review Court thus rejected the Prosecutor’s proposal, excluding the existence of that “functional proximity” between the Gallello and the mafia consortium, a key element for the application of prevention measures.
