Reggio Calabria, “Lampetra” operation: revoked the precautionary measure for Francesco Cimarosa

Today the Court of Appeal of Reggio Calabria, in acceptance of the request for revocation of the precautionary measure made by the lawyer Pierluigi Sacchetti of the Forum of Reggio Calabria, ordered the revocation of the precautionary measure of the obligation to present the PG against Francesco Cimarosa. The man had been arrested in July 2021 as part of the procedure called “Lampetra” operation, on charges of participation in a criminal association aimed at drug trafficking as well as various fine crimes always in the field of drugs.

Sentenced at first instance with a short -term rite to the sentence of 6 years and 2 months of imprisonment, following the appeal judgment to the same The sentence had been redetermined in 4 years and 6 months of imprisonment, Previa: acquittal by a head of charge, redevelopment in the hypothesis referred to in paragraph 5 of Article 73 Presidential Decree 309/90 for the other head and subject to the exclusion of the disputed aggravating circumstance pursuant to art. 416bis.1 cp from the associative dispute.

During the first and second degree judgments the same had been subjected to different precautionary measures, including the pre -trial detention in prison, house arrest, the prohibition of residence in the province of Reggio Calabria and finally the obligation to present the PG.

Following the judgment of Cimarosa, in consideration of the reform of the sentence made in his favor, he advanced – for the means of his lawyer Pierluigi Sacchetti – request for revocation of the measure.

The Court of Appeal today in acceptance of the aforementioned application has ordered the revocation of the precautionary measure against Cimarosa, which will now face the judgment in the Court of Cassation in total freedom and without any precautionary constraint.
