The Ministry of Justice was also condemned in the Supreme Court to rcompensation for damages in favor of the wife and four children of Salvatore Giofrè, 50 years old, of San Gregorio d’Ipponawho committed suicide in the Vibo Valentia prison on 29 June 2008. The Supreme Court in fact rejected the Ministry’s appeal, confirming the decision of the Court of Appeal of Catanzaro issued in August 2021. This is a partly historic sentence, waiting for the cifra consisting of compensation (168,250.00 euros in favor of each of the appellants)but above all the condemnation of the Ministry of Justice. The judges therefore accepted the appeal presented by the lawyers Giuseppe Di Renzo and Nicola D’Agostino.
Salvatore Giofrè, special public security guard, considered contiguous to the Fiarè-Gasparro-Razionale clanwas arrested on 28 June 2018 on charges of sexual assault against a 76-year-old woman from Maierato. In prison he had not stood up to the defamatory accusations made against him to the point of taking his own life.
The Ministry of Justice was cconvicted for failure to supervise as the public prosecutor, at the time of Salvatore Giofrè’s precautionary custody, had expressly established that he should be detained under a “common regime” in order to prevent his suicidal intentions or in any case make them more difficult due to the presence of others prisoners. The prisoner, however, was not subjected to any functional observation to verify his ability to adequately deal with the state of restriction, as neither the psychologist nor the educator were present when he entered prison.
